Terms of Use for Peak Finder

These are Terms of Use for Peak Finder("we", "us", "Service"), accessible from https://peakfinder.co and Peak Finder - Mountaineering portal application from thePandaApps in Google Play Store

If you continue to browse and use this website or our application, you are agreeing to comply with and be bound by the following terms and conditions of use, which together with our privacy policy govern our relationship with you in relation to this website and associated application. If you disagree with any part of these terms and conditions, please do not use our website and application.

General

Our Service provides users with an interactive map of peaks and hiking trails in the world with the core database of peaks and the whole database of trails gathered from free sources following their licences( OpenStreetMap, Wikipedia). Peak database contains the majority of the most interesting peaks with some areas more and some less well covered. Peak databse is expandable and registered users may add peaks that are missing.

For registerd users Peak Finder provides the ability to create ascents, treks and plans("Records") and interact with other users. These options are unavailable for not registered users.

Safe usage

Peak Finder takes no responsibility for any injuries or loss of orientation(or getting lost in general) resulting from using our Service. We advise you to always use our Service(especially our application) in a safe manner. Peak or trail information must not always be correct so you are advised to use common sense and use our Service as a guide or help. You should never blindly follow any direction provided by our Service and always evaluate your surroundings.

If you are following a trail make sure you still follow the trail markings, trail markings should coincide with trail map data. If you lose track of trail markings you should not further follow trail data from our Service because there could have been changes to that trail that are not yet reflected in our map.

Please also note that some mountains or mountain regions could be richer in ferromagnetic material which might confuse your magnetic field sensor resulting in misleading orientation information so you should be exceptionally careful using orientation information in mountains especially in the case mentioned here.

Incorrect peaks and trail are going to be corrected or removed.

Peak Finder does not encourage users to climb more peaks or hike longer trails or anyhow push their limits, we advise you to choose the mountains to climb or trails to hike wisely, according to your fitness and experience level and enjoy the adventure.

Registration

Our Service, the interaction and content available for registered users, is intended solely for persons who are 13 years old or older, or have reached the necessary age according to the law regulation of your country.

When registrating and creating an user profile you agree to: provide true, accurate, current and complete information about yourself("User Data") and will maintain and promptly update them.

If you provide any User Data that is inaccurate or not current, or Peak Finder has reasonable grounds to suspect that such User Data is inaccurate or not current, or do not represent or identify a person, Peak Finder has the right to suspend or terminate your account and refuse current or future use of our Service.

You are solely responsible for maintaining the confidentiality of the password associated with your account and for restricting access to your password, your computer and mobile device while logged into our Service. You accept responsibility for all activities that occur under your account or from your computer and mobile devices.

You may register or log-in to your account via a third-party network, such as Facebook. If you do so, you hereby authorize Peak Finder to pre-populate the registration and other relevant information fields of your account and/or to use such third-party credentials to log you into your account. If you connect your account to a third-party network, you agree to comply with the terms and conditions and policies applicable to such third party.

Email registration requires a verification of your email address by clicking a link sent to your mailbox. Unverified accounts will be removed after 30 days from the day of registration.

Peak Finder account/profile is intended for personal use only. The profile should represent a person, commercial entities, companies and any other commercial use is prohibited and will lead to account termination or block.

Account and Records privacy

Peak Finder allows users to use different privacy settings to match every individuals need for public interaction.

Account privacy types

public: your profile is visible to any user registerd and not registered
local: your profile is visible only to registered users. This privacy setting will make all your Records with public privacy to be considered as local
private: no one can see your profile except for you. This setting will make all your Records to be considered as private

Record privacy types

public: anyone can see your Record
local: only registered users can see your Record
friends: only your friends can see your Record
private: no one can see your Record except for you

Member data

Peaks

Every registered user has the right to submit new peaks to our database. Peak data provided must be accurate and represent a real peak that is not yet in our database with any of the data provided not being protected by any copyright. Peak data provided by the user (geographic location, picture, name, descriptions and other) become part of our database with full copy and redistrubution rights. Peaks added by users get an identificator marking the user who added them.

Users should submit only real peaks with correct peak data, submitting "fake" peaks will lead to a temporary or permanent block from using this feature and in case of violation of any other rule mentioned in this document may lead to a temporary or permanent account block.

Trails

Every registered user has the right to submit trails to our database. Trail data provided must be accurate and represent a real hiking trail that is not yet in our database with any of the data provided not being protected by any copyright. Trail data provided will become part of our database with full copy and redistrubution rights. Trail will get an identificator marking the user who addded it.

Users should submit only real trails with correct trail data, submitting "fake" trails will lead to a temporary or permanent block from using this feature and in case of violation of any other rule mentioned in this document may lead to a temporary or permanent account block.

Records

Registered users can log their ascents, treks and make plans. Other registered users may interact by etiher marking them as "liked" or by posting comments. Users should submit only real activities otherwise they might be removed by our administrators.

You grant us a license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, publicly perform and display content of your Records(except pictures) with privacy set to public or local. This license ends when you delete your Record or your account.

User interaction

Peak Finder allows members to interact on each Record created by other users(unless the Records or users privacy settings exclude him). Any rude or inappropriate behavior is not welcome and might result in temporary or permanent block from posting comments and in case of reapeated incidents or in combination with violation of any other rules mentioned in this document might lead to a temporary or permanent account block.

In-app features

Background Summit Monitor

Background Summit Monitor is a feature in our app that monitors your current location in an adaptive way to check for peak summits. None of the data acquired by this feature gets transmited to our server only when Eagle Eye is turned on and your location is within include/exclude zones definition.

This feature is enabled by default but can be turned off in settings.

Eagle Eye

Eagle Eye is a feature that enables users to see other users hiking location on the map according to their privacy setting. Every user decides when and where his location will be transmitted to the server and become visible on the map. Users can also clear the location history within app or on our website.

Eagle Eye does not transmit any location unless at least one include or exclude zone is defined within app. These zones should include mountain areas and exclude users privacy zones as a privacy measure.

Eagle Eye location gets updated autmatically along with Background Summit Monitor(in case this feature is turned on) or can be updated manually inside the Eagle Eye activity in our app. The above mentioned rule still applies and the location will not be updated in case you are not within include/exclude zones definition for both the automatical or manual location update.

Paid content

Summit Membership

Peak Finder offers some premium features as payed content called Summit Membership that are available after a successful payment in our app.

Summit Membership allows users to use Eagle Eye, Augmented Reality and add multi-segment records and removes some advertisements.

Peak Finder reserves the right to modify, update, extend or reduce this premium content at any time. Summit Membership is sold as a package that prolongs the expiration date according to the day count specified in the product name. In case a membership is active these days will be added on top of the current membership expiration date.

Peak Finder also offers a free trial of Summit Membership that can be activated within our app that lets users test the premium features for free.

Account deletion

You can request account deletion from within our apps My Profile screen(navigate from main navigation panel clicking the topmost row containing your profile picture and name) clicking options button(vertical 3 dots in the top right corner) and selecting "Delete account" option. After receiving your request we will send you a delete account link to your email to validate it is you. After clicking the provided link we will delete all your data and data associated with your account.

Changes to these Terms of Use

We may update our Terms of Use from time to time. Thus, you are advised to review this page periodically for any changes. We will notify you of any changes by posting the new Terms of Use on this page. These changes are effective immediately after they are posted on this page.
